MahaRERA Update: Developers to Pay Homebuyers Within 60 Days Under New SOP

Maharashtra Real Estate Regulatory Authority (MahaRERA) has introduced a landmark update aimed at protecting homebuyers by ensuring that compensation orders issued under RERA are enforced more swiftly and effectively. According to the new Standard Operating Procedure (SOP) announced on 22 November 2025. The developers are now required to pay compensation within 60 days of a MahaRERA adjudication order.

The SOP mandates that if a developer fails to comply with a compensation order, the affected homebuyer can file a non-compliance application. MahaRERA will then conduct a hearing within four weeks of receiving this application. If it is found that the developer has defaulted, the authority may grant a “reasonable time” to pay. But if the delay continues, the developer is required to submit an affidavit disclosing all movable and immovable assets, bank accounts, and investments.

To further strengthen the enforcement mechanism, MahaRERA will issue a Recovery Warrant to the District Collector, enabling attachment or seizure of the developer’s assets or bank accounts. In the most serious cases, if developers still fail to pay. They could face up to 3 months’ imprisonment, signaling that non-compliance will no longer be tolerated.

This move comes in response to frequent delays in actual payment to homebuyers even after favorable RERA orders. By enforcing a strict, time-bound framework, MahaRERA aims to uphold the Bombay High Court’s directions and deliver timely financial relief. Legal experts view this SOP as a “positive step,” though some caution that its real effectiveness will depend on consistent and strict implementation.
